1. Acceptance of Terms

By using NaviCast Eco ("Service", "Platform") or registering a vessel for monitoring, you agree to these Terms. If you act on behalf of a company, you confirm you have authority to bind that entity. If you do not agree, do not use the Service.

2. Service Description

NaviCast Eco monitors vessel speeds in real time using public AIS satellite data, compares them against user-defined eco-speed targets, and delivers Telegram alerts to designated contacts when thresholds are exceeded. The platform provides EU ETS cost estimations for informational purposes only.

Important: NaviCast Eco is an advisory tool. EU ETS compliance decisions, regulatory reporting, and any resulting fines or obligations remain the sole responsibility of the vessel operator.

All prices are exclusive of VAT. VAT is applied as required by EU law based on your billing country. We reserve the right to update pricing with 30 days' notice to existing subscribers.

4. Free Trial

New subscribers are eligible for a 14-day free trial. No credit card is required to start monitoring via the public registration form. At the end of the trial, monitoring stops unless you subscribe to a paid plan. We will send a reminder email 3 days before trial expiry.

AIS data delivery depends on the availability of aisstream.io and is not within our direct SLA. Scheduled maintenance is announced 48 hours in advance.

9. Data Ownership

You retain full ownership of all vessel data, IMO/MMSI numbers, and configuration data you enter. We claim no intellectual property rights over your data. AIS positional data is public maritime broadcast data.

10. Limitation of Liability

To the maximum extent permitted by EU law, NaviCast Eco shall not be liable for:

Our total liability for any claim shall not exceed the fees you paid in the 3 months preceding the claim. Nothing here limits liability for death, personal injury caused by negligence, or fraud.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS". WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT AIS DATA IS ACCURATE, COMPLETE, OR CURRENT. THE PLATFORM IS AN ADVISORY TOOL — COMPLIANCE DECISIONS REMAIN THE RESPONSIBILITY OF THE VESSEL OPERATOR.

12. Governing Law

These Terms are governed by EU law and the laws of the EU member state in which NaviCast Eco is registered. Disputes shall first be attempted through good-faith negotiation. If unresolved within 30 days, they go to the competent courts of our domicile, unless you are an EU consumer (in which case you may also use your local courts).

EU consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to Terms

We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
